Terms of Service

“Moonkanina” may also be referred to as “I”, “me", “my”, and “she” within this T.O.S.
“Client” may also be referred to as “you”, “your”, and “their” within this T.O.S.I. AGREEMENT:
By agreeing to the terms of service, the client agrees to the following:- Clients must be 18 years old or older to order a commission.- Prices can increase from the base price depending on the complexity of what is being commissioned. The client agrees that their commission will be handled case by case.- Clients do not have the right to mint/resell their commission for any reason, including NFT or AI purposes.- Clients do not have the right to use Moonkanina’s work for merchandise nor have the copyright of the work unless the client buys it from Moonkanina. There will be an upcharge on the final price of the commission to purchase the copyright.- Clients will not copy or trace Moonkanina’s work in any way.- Clients will not make any edits to commissioned work without permission.- Clients must credit and add Moonkanina’s handle on their social media platforms.- Moonkanina can decline or cancel a commission/ongoing commission if she is not comfortable with the client’s behavior, characters, or commission ideas.- Clients can use any art commissioned for their platforms (Twitch, Youtube, Discord, etc) with proper credit.- Moonkanina has the right to upload all artwork on multiple platforms. This includes WIPs and streaming the art progress on Twitch @chwowee. (click the link)- If your commission is supposed to be a secret or a surprise for someone/your community, you must pay a 25% fee on top of the total commission price in order for the work in progress to NOT be uploaded on any platform until it is delivered to the client/recipient.II. PAYMENT:
- Please message me through Twitter DMs or ask for my Discord to make a commission inquiry.- All prices are in U.S. Dollars ($)- All payments will be through PayPal and I will invoice you the total amount.- The total amount will be varied, case by case, depending on how detailed and complex you want the commission to be. Please look at the base prices here.- I will not work on a commission until the full payment is received OR we discuss a possible payment plan (half payment upfront) for large commissions.

III. GENERAL PROCESS:
- Commissions will take up to a few days, weeks, or even months depending on the quantity and complexity of the order. I will give you a rough estimate on that timeline. I will communicate as much as possible with the client about these matters.- For all commission types, the client will receive a sketch for approval. The client needs to request any changes during the sketch phase.- Changes requested by the client once the line art phase begins will incur additional fees.- If I want to make a change or addition during/past the line art phase, I will ask for the client’s opinion first on my idea for their approval. These additions/changes will NOT be charged.- In cases where I missed some small things/details, I will change it without any additional charge.
(For example: I got a character’s eye color wrong, or I forgot some piece of jewelry a character has)- I will occasionally send the client a few process pictures with a watermark to ensure there is no theft of any sort. Majority of WIPs will be on my Twitter or Twitch.- PLEASE BE VERY DESCRIPTIVE DURING THE COMMISSION PROCESS. I am not a mind reader and I struggle with vagueness. To ensure a faster experience to the get the desired results, please be very descriptive or show clear reference images.IV. REFUNDS:
- Full refunds may occur if a commission has been canceled before I have started working on it.- Partial refunds may occur if Moonkanina does not deliver the commission within a timely manner that was discussed with the client without a reason for the delay. (Exceeding 1 month with NO communication to explain the delay)- I will not offer a refund if you are unhappy with the commission after the delivery, as there were multiple opportunities to request changes.- I will not offer a full refund if you change your mind about how long the work is taking in the middle of the commission process. I will always give a rough estimate of how much time your order will take and any other updates that may delay/speed up the delivery. Please be respectful and understand that hours of my work would go to waste and I am not a machine that pumps out art work.V. DELIVERY:
- For emotes: Delivery of the final commission (png files) will include 3 Twitch emote sizes for each emote (112px, 55px & 28px)- For other commissions: I will typically send the original file size as pngs.- Completed commission files will be sent either through Discord in a zip file, or via Google Drive link through email/other social media platforms.VI. REMINDERS:
- I understand that some of these prices are high! However, when it comes down to the amount of hours I spend on research and creating your art, I don’t even make minimum wage. Please know that I try my best to offer affordability, but I can’t devalue my time or effort for others' benefit.- I will try to finish your commission promptly, but understand that I still have a life outside of art. My work hours and my personal life matters are separate.- I will not tolerate rudeness.- FOR EMOTES: emotes are tiny! The design I make will be very simplified to be more readable from a distance. Overly complex designs will be heavily simplified and I will discuss my approach with the client during the sketch phase to ensure satisfaction.- If you made it to the end and are currently reading this, DM me “that’s rough, buddy” and I will draw you a free yippee creature emote based on your selected character, model, etc on top of your order.
